Winding Up Petitions
MNS files winding up petitions as a protection against non-paying debtors. The petition is filed in the High Court of the state, where the debtor’s registered office is located. However, it is only possible in case the debtor is a company and acknowledgement from the debtor is available.
The advantages of filing a winding up petition through us are :
- It is cost competitive.
- It is time effective.
- No jurisdiction issue is involved.
- The winding up petition results in amicable settlement in case the debtor wants to remain in business.
Recovery suits are filed to recover both commercial and personal debts when there is no clear undertaking from the debtor. Especially when the debtor is not a registered company.
Summary proceedings, which are much faster that recovery suits, are possible under certain circumstances.
Criminal Cases
In clear cases of misrepresentation and fraud, we initiate criminal proceedings against the debtor. Filing a criminal case also helps compelling the debtor for out-of-court settlement.
