With effect from June 1, 2016, the Central Government constituted a specialized forum (the NCLT) to deal with company matters. In the first phase, the Ministry of Corporate Affairs had set up eleven Benches covering all major States and Union Territories. Subsequently, more Benches at Cuttack, Jaipur, Kochi, Amravati, and Indore have been setup.
We have an expertise in matters relating to the Insolvency & Bankruptcy Code (IBC) and regularly assist our clients on timely action and complex issues with NCLT claims.
Proceedings with NCLT under IBC can be initiated if there is an undisputed and acknowledged debt in writing.

• No jurisdiction issue is involved.

Recovery suits under the Civil Procedure Code and Commercial Courts Act are filed to recover both commercial and consumer debts when there is no unequivocal undertaking or acknowledgement from the debtor, especially when the debtor is not a registered company.

In cases involving misrepresentation, fraud, cheque dishonour and cheating, we give advice on initiation of criminal proceedings against the debtor. Such matters are dealt with by a separate panel of eminent criminal lawyers associated with MNS.
